1. Application
These Terms of Service (the “Terms”) set out the conditions for using FaceChanger AI (the “Service”). Users use the Service after agreeing to these Terms.
2. Definitions
- “User”: an individual or corporation that uses the Service.
- “Source Face Data”: face photos used as the “swapping side” (the replacing face).
- “Target Data”: images and videos that are the “swapped side” (the original being replaced).
- “Generated Data”: images, videos, and the like generated or edited by the Service.
- “Input Data”: a collective term for Source Face Data and Target Data.
3. Conditions of use
Users warrant the following.
- That the Input Data consists of images/videos of themselves, or that they have obtained permission from the necessary rights holders.
- That they use the Service in compliance with laws and regulations and these Terms.
3.1 Relationship with the Privacy Policy
The handling of user information, Input Data, and Generated Data in the Service is governed by our Privacy Policy. If there is any discrepancy between these Terms and the Privacy Policy, the Privacy Policy shall prevail with respect to the handling of user information and the like.
4. Prohibited acts (important)
Users must not engage in the following acts.
- Use for the purpose of impersonating others.
- Using a third party’s images/videos without that person’s consent.
- Use for sexual, violent, discriminatory, defamatory, fraudulent, or similar purposes.
- Use related to the activities of antisocial forces.
- Acts that interfere with the operation of the Service (excessive load, reverse engineering, etc.).
- Other acts that we deem inappropriate.
4.1 Additional prohibitions regarding face swapping
Users must not engage in the following acts.
- Using a third party’s face images, etc. as Source Face Data without that person’s consent.
- Using a third party’s images/videos as Target Data without that person’s consent.
5. Handling of and responsibility for generated content
- Use of Generated Data is at the User’s own responsibility, and the User bears all responsibility arising from the content and use of Generated Data.
- We do not warrant that Generated Data does not infringe the rights of third parties, nor its fitness for a particular purpose.
5.1 Retention period and deletion
The retention periods and deletion handling for Source Face Data, Target Data, and Generated Data are as set out in the Privacy Policy.
6. Paid plans and billing
- The content, prices, billing cycles, and availability of free trials for paid features are as displayed within the app.
- Subscriptions renew automatically until the User cancels through the procedures of each store (Apple/Google, etc.).
7. Refunds
Refunds follow each store’s policy (e.g., Apple’s refund policy). There may be cases where we cannot individually determine whether a refund is possible.
8. Suspension of use and accounts
If a User violates these Terms, we may suspend all or part of the User’s use of the Service, or suspend or delete the account, without prior notice.
9. Intellectual property rights
Intellectual property rights to the Service and related software, logos, designs, and the like belong to us or to the legitimate rights holders.
10. Disclaimer
We are not liable for any damage incurred by Users in connection with the Service, except in cases of our intentional misconduct or gross negligence.
11. Changes to the Terms
We may change these Terms as necessary. For material changes, we will notify users within the app or by methods designated by us.
12. Governing law and jurisdiction
These Terms are governed by the laws of Japan. In the event of a dispute concerning the Service, the court having jurisdiction over our location shall be the exclusive agreed jurisdictional court of first instance (subject to adjustment as necessary).
